TERMS AND CONDITIONS / FLEA MARKET RULES
The following terms and conditions define the agreement between you as the VENDOR and Polk Flea Market as FLEA
MARKET MANAGEMENT. Participating in the show is contingent on agreeing to, as well as adhering to, these rules. Flea
Market Management is defined as Flea Market Manager Deb Thomas and Flea Market Admissions Manager Tom Epping.
Failure to follow the verbal instructions of Flea Market Management may lead to Suspension and/or Termination from the
Polk Flea Market.
LAWS, RULES, AND REGULATIONS: All pertinent fire codes, laws, ordinances, and regulations pertaining to
health, fire prevention and public safety shall be strictly obeyed, VENDOR agrees to keep all merchandise, chairs,
and other equipment within the marked boundaries of the booth.
CONTENT OF BOOTH: Flea Market Management reserves the right to approve the contents and character of all
exhibits and reserves the right to prohibit or expel any merchandise that is out of keeping with the character of the
show. Adult items, or items not intended for family viewing are to be displayed where young children cannot view
them.
RELEASE AND HOLD HARMLESS AGREEMENT: The request to reserve VENDOR space constitutes an express
contractual agreement between myself and POLK FLEA MARKET, and it is understood and agreed that by signing
this agreement I fully and finally release and hold harmless both POLK FLEA MARKET, its agents and employees,
the Landlord of the venue, and its agents and employees from any and all liability for all claims of every nature and
kind whatsoever, including death, personal injury, loss, theft, or damages to personal property, whether or not caused
by POLK FLEA MARKET or Landlord’s own negligence or the negligence of their agents or employees.
PAYMENT & CANCELLATION: For returning vendors, payment for table rent will be picked up by a POLK FLEA
MARKET REPRESENTTIVE during the event. Vendors are required to give 7 days’ notice of cancellation for a flea
market. Flea Market Management will make every effort to fill your table. If a vendor is unable to provide 7 days’
notice of an absence, they may be responsible for payment of the table rent. We do understand that from time-to-
time emergencies come up outside of your control. We are sympathetic to those events.
SHOW HOURS: General Admission in all buildings is 9am-3pm on Sunday. No loading out of merchandise is allowed
until 3pm Sunday. Vendors with special circumstances who need to leave early should check in with show
management.
VENDOR CONDUCT: Vendors with concerns regarding the Polk County Fairgrounds Facility, Polk Fairgrounds
Personnel, Polk County Fairgrounds Rules & Regulations, and any issues with Customers should be brought directly
to the Flea Market Manager. Failure to follow proper protocol could result in termination from the Polk Flea Market.
Any behavior by a Polk Flea Market Vendor that is disruptive to the Polk Flea Market, other Flea Market Vendors, or
Flea Market Customers will be dealt with at the discretion of the Flea Market Manager. A Polk Flea Market Vendor
may be terminated at any time.
BOOTH CONDUCT: Subletting or donation of table, partially or in its entirety, is not permissible without the consent
of show management. (Space sharing is allowed.)
PARKING: Permanent Vendors will be issued a parking permit for the Vendor Parking area. Vendors may load and
unload in front of the building and by the doors during set-up hours and when the Polk Flea Market is closed. After
unloading Sunday, Vendors must park in the Vendor Parking Area. Vendors who are parking in Fire Lanes or other
unauthorized areas may be towed. Vendors with physical limitations will be provided a physically limited parking area
to park in Sunday. All other Vendors without limitations MUST park in designated Vendor parking at the back of the
parking lot by the museum by the admission station Sunday. Failure to park in the designated Vendor area may result
in termination from the Polk Flea Market.
PETS: The County Health Inspector has designated the Main Building and Building B of the Polk County Fairgrounds
as off limits to pets. Therefore, there are NO PETS ALLOWED. Service animals specially trained to aid a person with
a disability are welcome.
